Welcome to FluxAI. These Terms of Service (“Terms”) govern your access to and use of FluxAI’s website, AI agents, lead detection services, and related applications (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy.
2. Eligibility & Accounts
You must be at least 18 years old to use the Service. When you create an account, you represent that all information provided is accurate and complete. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3. Subscription & Billing
FluxAI services are provided on a recurring subscription basis. Fees are billed in advance according to your selected plan. All fees are non-refundable except as required by law. You may cancel your subscription at any time; however, termination will take effect at the end of the current billing cycle.
4. Acceptable Use
You agree not to use FluxAI for any unlawful purposes. Prohibited activities include reverse engineering our AI agents, scraping data from our platform, or using generated leads for bulk spamming or harassment. Any misuse of the service may result in immediate account suspension.
5. Intellectual Property
The Service, including its proprietary lead detection algorithms, AI architecture, brand assets, and platform content, remains the exclusive property of FluxAI. Your use of the Service grants you a limited, non-exclusive license for professional use only.
6. Disclaimers
FluxAI provides the Service on an 'as is' basis. While our AI agents are highly effective at finding high-intent prospects, we do not guarantee specific conversion rates, lead accuracy, or business revenue outcomes. Lead detection is dependent on external community data availability.
7. Limitation of Liability
To the fullest extent permitted by law, FluxAI shall not be liable for any indirect, incidental, or special damages. Our total liability for any claim arising out of these Terms shall not exceed the total amount of fees paid by you to us in the twelve months preceding the event giving rise to the claim.
8. Indemnity
You agree to indemnify and hold FluxAI harmless from any claims, losses, or legal fees resulting from your use of the Service, your breach of these Terms, or your violation of any third-party rights or applicable laws.
9. Termination
We reserve the right to suspend or terminate your access to the Service at our sole discretion, without notice, if we believe you have violated these Terms or engaged in conduct that is detrimental to the platform or other users.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law principles. Any legal actions must be brought within the appropriate courts located in said jurisdiction.
11. Changes to These Terms
FluxAI may update these Terms from time to time. We will notify you of any significant changes by posting the new Terms on this page and updating the “Last updated” date. Continued use of the Service after changes constitutes acceptance of the new Terms.
